It's always possible to download the iOS firmware, I could download iPhone OS 1.0 tomorrow - however since iOS 4 (I think?) they've been "signing" the firmware. This means that Apple can remotely enable or disable iOS firmwares from being installed. They usually stop signing one version within two weeks of an update being released, meaning 9.3.3 will likely stop being signed in the next few days.
