As the judge is likely to have no clue what anyone is talking about in this case, he is going to look back to previous, similar cases for a legal precedent, and the most recent, and similar is going to be the case that Apple LOST over the jailbreaking of iPhones.

If courts can tell Apple that there is no way they can use "Possiblity for piracy" as a defence against jailbreaking the iPhone, and that in fact jailbreaking an iPhone is now perfectly legal, then there is no possible way that they can say that Sony, who are using the same reason to sue Geohot, are in the right.

but you could still get banned selectively from certain games I bet, such as black ops.

Due to legal precedent, they will still have to look at similar cases, to look for the rulings that happened there. And as the Apple case is the most recent, the current precedent should stand, at jailbreaking devices, even if this opens the possibility of piracy, is legal.

Hacking an online game has nothing to do with the CFW. You could still be banned for this, as it's not jailbreaking your device..

I'm pretty sure they could work out for themselves, that hacking an online game has no relevance to jailbreaking a device :y:

Also, to the majority of people CFW means a lot more than challenge lobbies for COD.

Yeah i mean them winning that case would be comparable to throwing someone in jail because they bought a dinner knife but in the future they could stab someone with it haha...

Or Sony will just show the terms and conditions for PSN which say "I will not hack this product" so yeah how the he'll can he beat a legal contract that he signed, so sony is wrong.
