Can a Lag Switch Get You Banned?

I just recently made a lag switch and it works great, but I was just wondering if it could get me banned for life on XBL. I've heard that the only way you can get banned is if people file complaints on you is this true?

It will not get you banned.
They cannot physically prove it's a lag switch,
It could just be you have shitty interconnection.
