I dont think you would be be banned if you switched just the harddrive

Dang my 2nd ps3 is a 250 gb and my new one is 160 gb

it shouldn't ban you since everything on it will be formatted when you put it in the new system

a new drive formats when you put it in there a ban has absolutly nothing to do with it if you was banned via your hdd you could just format and whalla unbanned you are banned by your unique to system console id so you will be more than safe changing the hdd

You should be fine switching HDDs. You may still have your PSN account banned though, not sure...
