Hurah!
I just got off the phone with Sony's customer service with some more news!
About an hour ago I received my E-Mail that Sony was going to start banning people. At the bottom it had the phone number for customer service, so I decided to call it up and ask some questions... The audio file is below:

If thats the case then don't worry... We have been sending out warnings to people using the Call of Duty hack. If you are CAUGHT with the hack on your system you WILL be BANNED.

Ya, right. If you DO get banned CALL US and we'll see EXACTLY what you were banned for and what the problem is and take it from there. As long as you are not cheating or hacking you should be alright sir. Anything else I can assist you with?

So it looks like you can only get banned for modded lobbies as of now, how they will do it I haven't a clue. To be safe I would delete modded patches if I were you.
To do this:
- Go to the Game section of the XMB.
- Go to the very top folder called "Data Utility"
- Go down until you see Call of Duty
- Press triangle on it and select delete.
Also I would like to point out that the operator said that the E-Mail was sent to everyone, so I asked some of my friends if they received it and they said no. I think I have put enough info together to tell you that Infinity Ward just sent their Call of Duty ban list to Sony. Also ImmortalMods confirms that Treyarch sent their bans to Sony too.
ALSO I would like to point out that he did not say a SINGLE thing about piracy even though I said for breaking copyright and terms of service.

So i did it. I've been downloading all day and it seems that my saves are there (I haven't had time to try it.) I didn't do a full format of the hard drive because that would have taken 25 hours. i did the quick format. but i did do a system restore. so hopefully they'll leave me alone.
Thanks again for the heads up by the way on the back up for the saves. I was freaking.

Glad I could help. Yeah I told you it takes a long time to do a full format. I think I did a full one a year ago and took nearly 9 hours to complete on my new 500GB HDD.

Do you have a slim? i have a launch beast. I should be fine because it's a band new partition. and if sony is deep scanning my hard drive then i'll head down to their offices and punch them in the mouth.

No I have a 1.5 year old phat PS3 system. Luckily I have a 3 year insurance plan on it that covers everything, so if they ban my console, I'll just get a new one lol
