Hurah!
I just got off the phone with Sony's customer service with some more news!
About an hour ago I received my E-Mail that Sony was going to start banning people. At the bottom it had the phone number for customer service, so I decided to call it up and ask some questions... The audio file is below:

OK because we have been sending out E-Mails to consumers downloading the hack and WARNING them that you will get banned.

If thats the case then don't worry... We have been sending out warnings to people using the Call of Duty hack. If you are CAUGHT with the hack on your system you WILL be BANNED.

Ya, right. If you DO get banned CALL US and we'll see EXACTLY what you were banned for and what the problem is and take it from there. As long as you are not cheating or hacking you should be alright sir. Anything else I can assist you with?

So it looks like you can only get banned for modded lobbies as of now, how they will do it I haven't a clue. To be safe I would delete modded patches if I were you.
To do this:
- Go to the Game section of the XMB.
- Go to the very top folder called "Data Utility"
- Go down until you see Call of Duty
- Press triangle on it and select delete.
Also I would like to point out that the operator said that the E-Mail was sent to everyone, so I asked some of my friends if they received it and they said no. I think I have put enough info together to tell you that Infinity Ward just sent their Call of Duty ban list to Sony. Also ImmortalMods confirms that Treyarch sent their bans to Sony too.
ALSO I would like to point out that he did not say a SINGLE thing about piracy even though I said for breaking copyright and terms of service.
So there you are I will keep this update as I find out more... Hope you enjoyed.

yea but i would think that the fact that we could essentually dowload any movie or game that we want from their store would be alitt;e bit more important then challenge lobbies in one game

As the guy at customer service said they are sending emails to every psn user so, if they have to send 50million emails in a day it will take a while for it to get around to everyone...

if you think about it, they can tell if u bypass so thats how they know u have cfw and they make the assumption that you are cheating or backing up games. bc i wasnt cheating online or backingup games. and i didnt recieve the email til after i did the bypass, My friend that lives down the street has 3.56 ofw and we tried the bypass thing on his ps3 without exchanging the cert. , it didnt work so we used a proxy and what do u kno, He got an email saying there is cfw and all tht sh*t on his ps3. his ps3 is fairly new and never been hacked in any way and he is on 3.56.
So im guessing it has something to do with the bypass or proxy..

2 of 4 of my PSNs received this email. Strange... I have 2 ps3s, one with CFW and one with OFW, all psns log into both ps3s, and I dont do any COD hacks or anything, only did a few appear offlines (let me point out I only did those on the two psns that received the email) and change the name of the game you're playing, and of course "getting online" bypasses.

your right they are trying assuming because they can detect that ur using proxy or dns and say u are hacking/pirating/modding ur ps3 and can easily tell ur on ps3 3.55 which at most part it is true.
im guess there wont be 3.55 psn bypass stealth version?

haha well I have been console banned from Black Ops, deleted my patches for Black Ops before I updated to 3.56 xD. I have not yet recieved any email from sony pertaining to this so called "BAN." I also am running custom patches for MW2, W@W, and COD4 on my PS3. So I don't know if I will still be included in the ban, because as you stated, sony sent emails to everyone who will get banned, but until now I haven't recieved any email.
